Understanding “Compensated” Surrogacy in Canada: Why This Legal Opinion Matters

This new legal opinion doesn’t change what is allowed in Canada – but it does highlight how far surrogacy and families have come. The laws may be slow to catch up, but our commitment to clarity, compassion, and supporting our community every step of the way never will be.

Every once in a while, something comes along that reminds us why clear communication and transparency matter so much in surrogacy.

Lately, there has been a lot of conversation around compensated surrogacy in Canada – especially when intended parents live outside the country. A new independent legal opinion from Addario Law Group LLP took a closer look at how Assisted Human Reproduction Act (AHRA) applies in these situations.

While this opinion does not change the law, it is an important reminder of how it is interpreted today and why staying informed matters.

What This Legal Opinion Really Says

Here is the heart of it, in simple terms:

  • Paying a surrogate in Canada for her services is a criminal offence under the AHRA.
  • It doesn’t matter where the intended parents live or where the money comes from – if the surrogate lives in Canada, the same law applies.
  • Reimbursement of approved expenses is allowed, but only with proper documentation.
  • Canadian authorities can investigate and prosecute, even if the intended parents or agencies are based outside the country.
  • This is not a change in law – just a clear reinforcement of how it is currently understood.

What This Means for Surrogates

For surrogates in Canada, this is about keeping things transparent and simple.

You should only ever receive reimbursements for eligible expenses, things like travel, medical costs, and pregnancy-related needs that fit within legal guidelines.

Our team helps make this part less overwhelming. We walk through what is allowed, what is not, and how to keep receipts and records stress-free so you can focus on what really matters: your journey.

What This Means for Intended Parents

Whether you live in Canada or abroad, it is important to know that compensation beyond reimbursable expenses is not permitted.

We guide all intended parents through what can be covered and how to handle reimbursement properly. That way, everyone can feel confident they are doing things the right way, with clarity, compliance, and care at the centre.

Why This Conversation Matters

The AHRA was written more than 20 years ago. Surrogacy has evolved a lot since then families have grown, journeys have changed, and our community looks very different today.

This legal opinion does not reflect something new; it simply shines a light on how much the landscape has shifted while the laws have stayed still.

That’s why conversations like this matter. It’s how we keep our community informed, supported, and empowered to navigate their journeys confidently.
