Is Surrogacy Legal In Canada?

The answer is yes, Surrogacy has been legal in Canada since March 2004. There are conditions to the law of course such as, a Surrogate cannot be paid for her services, however, she can be reimbursed for all expenses (living cost, food, medical, etc.)

Coming to Canada for Surrogacy is not the cheapest option, there are other countries that allow Surrogacy. However, some of these are less developed countries and so the medical and legal risk are higher.

Stable Legal Environment

The fact is, some countries just don’t have the stable legal environment that Canada does. And that can lead to legal problems down the road.

We work closely with lawyers that will guide you through the legal avenues such as: passport acquisition, hospital birth registry, and the birth certificate.

Did you know that in certain provinces in Canada you can have both Intended Parents names on the birth certificate without a DNA test? Now, with the assistance of a lawyer, IPs who use an egg and/or sperm donor have the opportunity to be listed on the birth certificate as the parents.

What Citizenship Is The Child?

The baby will leave Canada with a Canadian passport. However, bringing a child across international borders with the proper documentation is fraught. Which is why we rely on ours and your legal team to point out any problems along the way and to address them as soon as possible.
